The institution of superficiary right of building in the private law restatement in the Czech Republic

The Institute of the Right to Build in the Context of the Recodification of Private Law in the Czech Republic Abstract This master thesis is devoted to a comprehensive analysis of the legal regulation of the right to build as a legal institute reintroduced into the legal system of the Czech Republic on 1 January 2014 with the entry into force of the Act No. 89/2012 Coll., the Czech Civil Code, including the placing of the right to build in the context of its historical background or its comparison with the corresponding applicable legal regulations of foreign countries, which represent sources of inspiration for the legal regulation in the Czech Republic. The right to build allows, in particular, the construction of a building by the builder on land that is not owned by him, or, in general, allows the builder to have a building on such land. This legal institute represents a special temporary exception of application of the legal principle of superficies solo cedit. The building, which becomes part of the right to build for the duration of the right itself, does not, according to the general rules of law, accrue to the land on which it has been built. Tree Chamber in the castle of Bechyně

The bachelor thesis deals with the space and decoration of the so-called Tree Chamber in the castle of Bechyně. The interest of Tereza Fialová is confined to the person of the builder Ladislav from Šternberk, who let the chamber present like an allusium of the natural environment. The unclear function of the uniquely conceived space is interpreted on the basis of comparison with the other areas of the settlements of the significant aristocratic families in the territory of southern Bohemia. Another part of the bachelor thesis is a material examination of the space, which results in the research of the preserved decoration, the analysis of the used material and the documentation of the stone stamps. Particular attention is given to the potential architect of the chamber, Wendel Roskopf, whose authorship is verified on the basis of an analysis of his life-work and artistic expression in connection with the decorative concept of the stone decoration. The bachelor thesis is closed by the definition of the theoretical sources of the naturalistic imitation of the natural motives in late Gothic sacral and profane architecture.
Superficiary right of building and other possibilities of building on land of another

The topic of this thesis is the superficiary right of building (and other possibilities of building on the land belonging to a third party, though the focus is primarily on the institution of the superficiary right of building). The principle "superficies solo cedit" was reintroduced in Czech legislation when the new Civil Code (Act No. 89/2012, Coll.) came into force. Along with this principle, the institution known as superficiary right of building has also returned to Czech law after a hiatus of more than 50 years. This thesis seeks to provide a comprehensive interpretation of the superficiary right of building, to explain the individual rights and obligations arising from the superficiary right of building, and to compare the institution of superficiary right of building to other possibilities of erecting a building on land which belongs to someone else. The first chapter defines some of the basic concepts which facilitate the explanation of individual issues and the understanding of certain connections in the following chapters. The thesis is focused on institute called right to build and other possibilities to build on somebody else's land in accordance with Civil Code effective since 1. 1. 2014. It also defines important terms connected to the right to build, its history on Czech territory and its foreign form which can be used as source of inspiration for future practice. Part of the thesis deals with unauthorized structures on somebody else's land which are built on the land without a legal reason.

Usufructuary right of building and other ways of erecting house on the land of another The purpose of this thesis is to analyse comprehensively the institute of usufructuary right of building and other ways of erecting house on the land of another. Other legal institutes that can be used to set up home on a foreign land are easements, lease, usufructuary lease, precarious loan and loan for use. The Civil Code, after more than sixty years, is returning to the superficial principle, with which is the usufructuary right of building inherently connected and which represents an exception from that principle. Thesis is divided into four parts. The largest is the first part, which deals with the usufructuary right of building. The second part is devoted to other institutes, which enable the establishment of a house on a foreign land. Right to build in taxes and accounting

This bachelor thesis discusses the legal institute of right to build, which has been reintroduced into our lives by Act 89/2012 Coll, Civil Code, and which is related to a wide number of changes, not only in private law. The thesis firstly introduces the right to build from the point of view of the Civil Code, which characterizes and explains its use in private relations. Further on the thesis explains the effect which the institute has in tax and accounting, therefore, in public law. The thesis introduces the way of accounting about the institute, which taxes is it subject to and it also presents the issues that arise from the specificity of the institute.
Castle in Třeboň during the reign of last Rosenbergs.

The bachelor's thesis deals with a summary of the structural works, which took place at Třebon castle on the command of last two Rosenbergs nobles Vilem and Petr Vok of Rosenberg between the years 1565 - 1612. In the first chapter the thesis focuses on the castle itself, on its current and historical appearance and structural interventions which both Rosenbergs left to do. In the end of the chapter concludes the question of authorship of certain construction elements. In the next chapter, the author focuses more on the person of Vilem of Rosenberg and his role as a builder. The chapter is also supplemented with a brief recap of Vilem's life, and in the end deals with question of reasons of castle's reconstruction. The part about Petr Vok is solved in the same manner. In the end of this chapter is dealing the question of choosing the Třebon as a last family residence.
